Terms of Service
These Terms of Service (“Terms”) govern your use of hunchtarot.com, app.hunchtarot.com and related Hunch Tarot services (the “Service”). By using the Service, you agree to these Terms.
Hunch is a creative and reflective tarot experience. Outputs are generated partly by automated systems and are not guarantees, predictions of fact, or substitutes for professional medical, legal, financial or mental-health advice.
1. Eligibility and accounts
You must be legally capable of agreeing to these Terms. You are responsible for your account, the accuracy of information you provide and activity performed through your account.
2. User content and photos
You retain ownership of content you submit to Hunch, including text, prompts, photos and other uploads (“User Content”), subject to any rights owned by others.
You grant Hunch a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, transmit, display, adapt, transform and otherwise process User Content to the extent reasonably necessary to:
- provide the Service and features you request;
- generate and deliver personalised cards, images, readings and other outputs;
- maintain your history, account state and saved content;
- operate, secure, troubleshoot and improve the Service;
- prevent fraud, abuse and security incidents; and
- comply with law and enforce these Terms.
This licence lasts only for as long as reasonably necessary for those purposes and any lawful retention period described in our Privacy Policy.
3. Your promises about uploaded content
You represent that you have all rights, permissions and lawful bases necessary to submit User Content and permit Hunch to process it as described in these Terms and the Privacy Policy.
If you upload a photo of another person, you are responsible for ensuring that your use of that image and submission to Hunch is lawful and authorised.
4. AI-generated outputs
The Service may use third-party and proprietary AI systems. Outputs may be inaccurate, unexpected, similar to content produced for others, or unsuitable for your intended purpose. You are responsible for reviewing outputs before relying on, publishing or sharing them.
Subject to applicable law and third-party rights, you may use outputs generated for you. Hunch does not guarantee that any output is unique, protectable by intellectual-property law, or free from third-party claims.
5. Acceptable use
You may not use the Service to:
- violate law or another person’s rights;
- upload content you do not have the right to use;
- impersonate, harass, exploit or defraud others;
- circumvent access, security, payment or usage controls;
- introduce malware or interfere with the Service;
- use generated content deceptively in a way that creates unlawful harm; or
- attempt to reverse engineer or abuse the Service except where law expressly permits.
6. Subscriptions and payments
Paid features may be offered on a subscription, credit or usage basis. Prices, billing periods, renewal terms, cancellation options and applicable taxes are shown at purchase. Third-party app stores or payment providers may impose additional terms.
7. Service changes and availability
We may add, remove or modify features, models, limits, providers or pricing. We may suspend or restrict access where reasonably necessary for security, maintenance, abuse prevention, legal compliance or non-payment.
8. Intellectual property
Hunch, its branding, software, site design and original materials are owned by Hunch or its licensors and are protected by applicable intellectual-property laws. These Terms do not transfer ownership of Hunch intellectual property to you.
9. Third-party services
The Service may rely on third-party providers for hosting, payments, analytics, communications and AI/image generation. Their services may be subject to their own terms and availability. Hunch is not responsible for third-party services outside our reasonable control.
10. Privacy
Our Privacy Policy explains how we collect, use, store and share personal information, including photos, prompts and generated content.
11. Disclaimers
To the maximum extent permitted by law, the Service is provided “as is” and “as available”. We do not guarantee uninterrupted availability, specific outcomes, rankings, predictions, accuracy, compatibility or fitness for a particular purpose.
Nothing in these Terms excludes rights or warranties that cannot legally be excluded.
12. Limitation of liability
To the maximum extent permitted by law, Hunch will not be liable for indirect, incidental, special or consequential loss, loss of profits, business, goodwill, data or opportunity arising from use of the Service.
Where liability cannot be excluded, our aggregate liability relating to the Service will be limited to the greater of the amount you paid Hunch for the Service in the 12 months before the event giving rise to the claim or £100, unless applicable law requires a higher amount.
Nothing in these Terms limits liability for fraud, fraudulent misrepresentation, death or personal injury caused by negligence, or any other liability that cannot legally be limited.
13. Termination
You may stop using the Service at any time. We may suspend or terminate access for material breach, abuse, security risk, legal requirements or non-payment. Provisions that by their nature should survive termination will survive.
14. Governing law
These Terms are governed by the laws of England and Wales, subject to mandatory consumer protections that apply where you live. Courts of England and Wales will have jurisdiction except where applicable consumer law gives you the right to bring proceedings elsewhere.
15. Changes
We may update these Terms as the Service or law changes. Material changes may be communicated through the Service. Continued use after an updated effective date constitutes acceptance where permitted by law.
